Family & Matrimonial

If your marriage or relationship with your partner has run into difficulty it is important that during such an emotionally vulnerable time you do not lose or give up your legal rights. Those rights could include financial arrangements, property and access or custody of children. Most marriages or relationships have their ups and downs but where the breakdown has become or looks as if it will become irreparable then it is time to see a solicitor. We will provide completely confidential, sympathetic yet practical advice on such matters as next practical steps, maintenance, arrangements for children, divorce or separation and financial and property matters arising on the breakdown of the relationship.

If you are a victim of domestic violence or concerned for your safety or the safety of your children we will be able to take fast and effective legal steps to protect you. The law is there to help you. We regularly obtain emergency court orders to protect and assist clients who are the subject of physical violence or threatening or abusive behaviour within the home or from ex-partners, as well as orders to exclude the perpetrators from in or around the victim’s home or workplace. We provide free advice and assistance to detained persons in police stations throughout Northern Ireland on a 24 hr basis. Probate & Wills

Making a will is the only way you can be sure that your wishes will be followed after you die. If you do not make one, all or part of your estate may go to people who you never intended to benefit. Not only that, inheritance tax legislation means that, if you don’t prepare properly, a substantial part of what you leave behind may be payable in taxes.

Wills are not solely about passing on your assets. You can also include specific funeral arrangements. For instance, burial, cremation or the use of your body for medical research can be specified in your will. You may also want to appoint legal guardians to care for your minor children if you and your partner should both die before they are eighteen.

Another important consideration is the appointment of executors. These are the people who will deal with your estate in the event of your death. Ideally these should be business minded family or friends, or professional advisers.

It is important to review your Will regularly – ideally at least once every five years. You should also review your will after any change in your family circumstances, such as death divorce or bankruptcy, or any publicised change to tax legislation.

Probate is the legal process in dealing with a person’s estate after they die. This involves identifying their assets and ensuring that these are preserved, collected in and distributed in accordance with their will or, if there is no will, in accordance with the law. This also involves settling any debts or claims against the estate and dealing with tax affairs in respect of the estate. We have the experience to guide you through this whole process and what is a very difficult time.
